Termos e Condições

Estes termos e condições aplicam-se ao aplicativo Q-Figurinhas (doravante denominado "Aplicativo") para dispositivos móveis, criado pela Qualidata Soluções em Informática (doravante denominada "Provedor de Serviços") como um serviço suportado por anúncios.

Ao baixar ou utilizar o Aplicativo, você concorda automaticamente com os seguintes termos. É altamente recomendável que você leia com atenção e compreenda estes termos antes de usar o Aplicativo.

A cópia ou modificação não autorizada do Aplicativo, de qualquer parte do Aplicativo ou de nossas marcas registradas é estritamente proibida. Qualquer tentativa de extrair o código-fonte do Aplicativo, traduzi-lo para outros idiomas ou criar versões derivadas não é permitida. Todas as marcas registradas, direitos autorais, direitos de banco de dados e outros direitos de propriedade intelectual relacionados ao Aplicativo permanecem de propriedade do Provedor de Serviços.

O Provedor de Serviços dedica-se a garantir que o Aplicativo seja o mais útil e eficiente possível. Sendo assim, reserva-se o direito de fazer modificações no Aplicativo ou cobrar por seus serviços a qualquer momento e por qualquer motivo. O Provedor de Serviços assegura que quaisquer cobranças pelo Aplicativo ou por seus serviços serão comunicadas claramente a você.

O Aplicativo armazena e processa os dados pessoais que você forneceu ao Provedor de Serviços a fim de fornecer o Serviço. É sua responsabilidade manter a segurança do seu telefone e o acesso ao Aplicativo. O Provedor de Serviços desaconselha fortemente fazer o jailbreak ou o root no seu telefone, o que envolve a remoção de restrições de software e limitações impostas pelo sistema operacional oficial do seu dispositivo. Tais ações podem expor seu telefone a malwares, vírus e programas maliciosos, comprometer os recursos de segurança do seu telefone e podem resultar no mau funcionamento do Aplicativo ou na sua inoperância total.

Isenção de Responsabilidade dos Provedores de Plataforma (Apple e Google)

Observe que estes Termos e Condições são celebrados apenas entre você e o Provedor de Serviços, e não com a Apple Inc. ("Apple") ou o Google LLC ("Google"). O Provedor de Serviços, e não a Apple ou o Google, é o único responsável pelo Aplicativo e por seu conteúdo.

Manutenção e Suporte: Nem a Apple nem o Google têm qualquer obrigação de fornecer quaisquer serviços de manutenção e suporte em relação ao Aplicativo.
Isenção de Responsabilidade: Nem a Apple nem o Google são responsáveis por lidar com quaisquer reivindicações suas ou de terceiros relacionadas ao Aplicativo ou à sua posse e/ou uso do Aplicativo, incluindo, mas não se limitando a: (i) reivindicações de responsabilidade pelo produto; (ii) qualquer reivindicação de que o Aplicativo não esteja em conformidade com qualquer requisito legal ou regulamentar aplicável; e (iii) reivindicações decorrentes de proteção ao consumidor ou legislação semelhante.
Propriedade Intelectual: No caso de qualquer reivindicação de terceiros de que o Aplicativo ou sua posse e uso do Aplicativo infringem os direitos de propriedade intelectual desse terceiro, o Provedor de Serviços, e não a Apple ou o Google, será o único responsável pela investigação, defesa, acordo e quitação de qualquer reivindicação de violação de propriedade intelectual.
Terceiros Beneficiários: A Apple e o Google, e suas respectivas subsidiárias, são terceiros beneficiários destes Termos e Condições. Após a sua aceitação destes Termos e Condições, a Apple e/ou o Google terão o direito (e será considerado que aceitaram o direito) de fazer cumprir estes Termos e Condições contra você como terceiros beneficiários destes.
EULA Padrão: O uso do Aplicativo também está sujeito ao Contrato de Licença de Usuário Final de Aplicativo Licenciado Padrão da Apple (EULA) para usuários de iOS.

Observe que o Aplicativo utiliza serviços de terceiros que possuem seus próprios Termos e Condições. Abaixo estão os links para os Termos e Condições dos provedores de serviços de terceiros usados pelo Aplicativo:

Esteja ciente de que o Provedor de Serviços não assume responsabilidade por certos aspectos. Algumas funções do Aplicativo exigem uma conexão ativa com a internet, que pode ser Wi-Fi ou fornecida pelo seu provedor de rede móvel. O Provedor de Serviços não pode ser responsabilizado se o Aplicativo não funcionar em sua capacidade total devido à falta de acesso ao Wi-Fi ou se você tiver esgotado sua franquia de dados.

Se você estiver usando o aplicativo fora de uma área com Wi-Fi, lembre-se de que os termos do contrato do seu provedor de rede móvel ainda se aplicam. Consequentemente, você pode ser cobrado pela sua operadora móvel pelo uso de dados durante a conexão com o aplicativo, ou incorrer em outras cobranças de terceiros. Ao usar o aplicativo, você aceita a responsabilidade por tais cobranças, incluindo cobranças de dados em roaming, caso use o aplicativo fora do seu território de origem (ou seja, região ou país) sem desativar o roaming de dados. Se você não for o titular da conta do dispositivo no qual está usando o aplicativo, presume-se que você obteve permissão do titular da conta.

Da mesma forma, o Provedor de Serviços nem sempre pode assumir a responsabilidade pelo seu uso do aplicativo. Por exemplo, é sua responsabilidade garantir que seu dispositivo permaneça carregado. Se a bateria do seu dispositivo acabar e você não puder acessar o Serviço, o Provedor de Serviços não poderá ser responsabilizado.

Em relação à responsabilidade do Provedor de Serviços pelo seu uso do aplicativo, é importante observar que, embora eles se esforcem para garantir que o mesmo esteja sempre atualizado e preciso, eles dependem de terceiros para fornecer informações para que possam disponibilizá-las a você. O Provedor de Serviços não aceita qualquer responsabilidade por qualquer perda, direta ou indireta, que você venha a sofrer como resultado de confiar inteiramente nesta funcionalidade do aplicativo.

O Provedor de Serviços pode desejar atualizar o aplicativo em algum momento. O aplicativo está atualmente disponível conforme os requisitos do sistema operacional (e de quaisquer sistemas adicionais para os quais decidirem estender a disponibilidade do aplicativo), que podem mudar, e você precisará baixar as atualizações se quiser continuar usando o aplicativo. O Provedor de Serviços não garante que sempre atualizará o aplicativo para que seja relevante para você e/ou compatível com a versão específica do sistema operacional instalada em seu dispositivo. No entanto, você concorda em sempre aceitar as atualizações do aplicativo quando oferecidas a você. O Provedor de Serviços também pode desejar parar de fornecer o aplicativo e pode encerrar o seu uso a qualquer momento, sem aviso prévio de rescisão. A menos que seja informado o contrário, em caso de encerramento, (a) os direitos e licenças concedidos a você nestes termos serão encerrados; (b) você deverá parar de usar o aplicativo e (se necessário) excluí-lo do seu dispositivo.

Conteúdo Gerado pelo Usuário

O Aplicativo pode permitir que você crie, envie, poste, exiba, transmita, execute, publique, distribua ou veicule conteúdos e materiais para o Provedor de Serviços ou no Aplicativo, incluindo, mas não se limitando a texto, escritos, vídeo, áudio, fotografias, gráficos, comentários, sugestões, informações pessoais ou outros materiais (coletivamente, "Conteúdo do Usuário").

O Provedor de Serviços mantém uma rigorosa política de tolerância zero em relação a Conteúdos Inadequados. Conteúdos Inadequados incluem, mas não se limitam a, conteúdos que sejam:

Considerados ofensivos, como conteúdos que promovam o racismo, fanatismo, ódio ou dano físico de qualquer tipo contra qualquer grupo ou indivíduo;
De assédio ou que defendam o assédio a outra pessoa;
Que promovam atividades ilegais ou condutas abusivas, ameaçadoras, obscenas, difamatórias ou caluniosas;
De natureza pornográfica ou sexualmente explícitos.

O Provedor de Serviços reserva-se o direito de revisar e remover qualquer Conteúdo do Usuário que viole estes termos. Os usuários flagrados publicando Conteúdos Inadequados ou adotando comportamentos abusivos serão bloqueados e terão seu acesso ao Aplicativo encerrado imediatamente.

Para garantir um ambiente seguro, o Aplicativo fornece um recurso interno para que os usuários sinalizem e denunciem Conteúdos Inadequados ou usuários abusivos. O Provedor de Serviços compromete-se a analisar todas as denúncias e tomar as medidas necessárias — que podem incluir a remoção do conteúdo ofensivo e/ou o banimento permanente do usuário responsável — dentro de 24 horas após o recebimento da denúncia.

Alterações nestes Termos e Condições

O Provedor de Serviços pode atualizar periodicamente seus Termos e Condições. Portanto, recomendamos que você revise esta página regularmente para verificar quaisquer alterações. O Provedor de Serviços o notificará sobre quaisquer alterações publicando os novos Termos e Condições nesta página.

Estes termos e condições entram em vigor a partir de 20/01/2026.

These terms and conditions apply to the Q-Figurinhas app (hereby referred to as "Application") for mobile devices that was created by Qualidata Soluções em Informática (hereby referred to as "Service Provider") as an Ad Supported service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Platform Providers Disclaimer (Apple and Google)

Please note that these Terms and Conditions are concluded between you and the Service Provider only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). The Service Provider, not Apple or Google, is solely responsible for the Application and its content.

Maintenance and Support: Neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Disclaimer of Liability: Neither Apple nor Google is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
Intellectual Property: In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, the Service Provider, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Third-Party Beneficiaries: Apple and Google, and their respective subsidiaries, are third-party beneficiaries of these Terms and Conditions. Upon your acceptance of these Terms and Conditions, Apple and/or Google will have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as a third-party beneficiary thereof.
Standard EULA: Use of the Application is also subject to the Apple Standard Licensed Application End User License Agreement (EULA) for iOS users.

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

User Generated Content

The Application may allow you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to the Service Provider or on the Application, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "User Content").

The Service Provider maintains a strict zero-tolerance policy regarding Objectionable Content. Objectionable Content includes, but is not limited to, content that is:

Deemed offensive, such as content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;
Harassing or advocates harassment of another person;
Promoting illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;
Pornographic or sexually explicit in nature.

The Service Provider reserves the right to review and remove any User Content that violates these terms. Users found posting Objectionable Content or engaging in abusive behavior will be blocked and have their access to the Application terminated immediately.

To ensure a safe environment, the Application provides an in-app feature for users to flag and report Objectionable Content or abusive users. The Service Provider is committed to reviewing all reports and taking necessary actions—which may include removing the offending content and/or permanently banning the responsible user—within 24 hours of receiving the report.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
